§ 7-9. Bulk storage of liquid propane regulated.

  • (a)

    The term "liquid propane" whenever used in this section shall mean the term as defined in the National Fire Protection Association's Definition Number 58 entitled, "Storage and Handling of Liquefied Petroleum Gas" as recognized and enforced by the Connecticut Commissioner of Public Safety and State Fire Marshal pursuant to Section 29-331 of the Connecticut General Statutes and sections of the Regulations of Connecticut State Agencies adopted pursuant thereto, as of the effective date of this section and as amended from time to time. "Bulk storage" shall mean any container that has a capacity that equals or exceeds one thousand (1,000) gallons. "Fire District No. 1," "Fire District No. 2," and "outer fire limits" shall have the same meanings as set forth in chapter 5, buildings and building regulations, of this Code.

    (b)

    The city fire marshal may approve the bulk storage of liquid propane in the "outer fire limits" provided that there is verification that the bulk storage tank plans meet all of the following:

    (1)

    The proposed placement and use of the liquid propane storage tank meets all state and federal requirements.

    (2)

    The applicant has obtained a certificate of zoning compliance for the use or proposed use of the premises on which the liquid propane tank is to be placed.

    (3)

    The tank manufacturer's recommendations or instructions for installation will be met.

    (4)

    Provisions are provided for the physical protection of the storage tank so as to prevent its exposure to accidental collision or any other reasonably foreseeable hazards arising generally or specifically from its placement at the premises.

    (5)

    Provisions have been made for securing the tank's associated apparatus from unauthorized use or discharge.

    (6)

    Provisions have been made for screening tanks placed outside so as to minimize the impact of undesirable noise, fumes, and any other activity associated with its use that reasonably can be foreseen to disturb the peaceful enjoyment of neighboring property or to disrupt passers-by.

    (c)

    The bulk storage of liquid propane is allowed in "Fire District No. 1" and "Fire District No. 2" upon verification by the city fire marshal that the bulk storage tank meets all of the provisions required for the bulk storage of liquid propane in the "outer fire limits" with the further requirement that all of the following city officials have reviewed the application and consent to the granting of the approval:

    (1)

    City planner.

    (2)

    Building official.

    (3)

    Fire chief.

    (4)

    Police chief.

    (d)

    The provisions of paragraphs (b) and (c) above shall be in addition to any other applicable law or ordinance and shall not limit in any way the authority of the city building official, fire marshal, or any other city official to enforce any other applicable law or ordinance.
