§ 2-91. Definitions.

(a)

Except as otherwise provided in these sections 2-90 et seq., the terms set forth in this division shall have the same meaning as set forth in section 2-66 of division 5, except that "pay" as defined in section 2-66 of division 5, shall not apply to these sections 2-90 et seq.

The following terms shall have the following meanings for purposes of this division:

Compensation shall mean the annual rate of base salary for the rank and step occupied by the member, as set forth in the applicable bargaining agreement, or, if compensation for such member's rank and step is not set forth in an applicable bargaining agreement, the annual rate of base salary for the member. Compensation shall include any salary reduction amounts under Code Section 125, 414(h) and 457, and effective January 1, 2001, qualified transportation fringes as set forth in Section 132(f)(4) of the Code. In no event shall "compensation" mean salary or wages or other amounts in excess of two-hundred twenty thousand dollars ($220,000.00) (increased as permitted under Section 401(a)(17) of the Code to reflect cost-of-living adjustments).

Continuous service shall mean the period beginning on the member's date of hire by the city as a police officer and ending on the date the member ceases to be employed by the city as a police officer. Service as a city employee in a capacity other than as a police officer shall not be included in continuous service for purposes of this section, except that any service earned under the general city plan by the animal control officer and/or assistant animal control officer shall be considered years of continuous service for purposes of this retirement system. A member shall receive continuous service credit for periods of time during which the member is on an authorized leave of absence, whether or not paid, so long as such member is making contributions during such leave. A member shall also receive continuous service credit for periods of time during which the member is on leave under the Family and Medical Leave Act, regardless of whether he or she is making contributions during such period.

Member shall mean a police officer eligible to receive retirement benefits under these sections 2-90 et seq.

Police officer shall mean an individual employed by the City of Bristol Police Department as a regular police officer, or effective April 12, 2005, as the animal control officer or assistant animal control officer.

Retirement board or the board shall mean the board created for the administration of the retirement system pursuant to section 2-68.

Retirement fund shall mean the fund derived from contributions made as provided in this division for the payment of pensions to city employees employed as police officers retired under this division.

Spouse shall mean a member's spouse or civil union partner under the laws of the state in which the member resides.
