§ 2.5-7. Penalties.

(a)

An alarm user who maintains an alarm system that is prohibited by this chapter, or who fails to register an alarm system as required commits an infraction and shall be fined ninety dollars ($90.00) for each and every day of violation.

(b)

Any alarm user whose alarm system violates this chapter as it relates to the duration of an audible alarm, or who fails to comply with any procedures required by the police chief for "hold up" alarms commits an infraction and shall be fined ninety dollars ($90.00) for each and every violation.

(c)

Any alarm user who fails to pay a false alarm charge within fifteen (15) days of the false alarm assessment shall render the false alarm user liable to a penalty equal to twice the amount of the initial penalty provided. Any alarm user who fails to pay a false alarm charge within thirty (30) days of the false alarm assessment shall render the said alarm user liable to a penalty equal to three (3) times the amount of the initial penalty provided. Any alarm user will be required to pay all costs of collection including court costs and reasonable attorney fees not in excess of fifteen (15) percent of the unpaid debt if legal action is commenced.

(d)

Any alarm user referred to in subsection (c) above may also be subject to the enforcement procedures outlined in chapter 23 of the Code.
