§ 18-5. Establishment of municipal penalties for violations of zoning regulations.

  • (a)

    Pursuant to Section 8-12a of the Connecticut General Statutes, the City of Bristol hereby establishes municipal penalties for violations of zoning regulations adopted under Section 8-2 of the Connecticut General Statutes, or by special act.

    (b)

    The types of zoning violations for which citations may be issued by a citation officer designated pursuant to Section 7-148(c)(10) of the Connecticut General Statutes, shall be any zoning regulation adopted under proper authority by the Bristol Zoning Commission. Said zoning regulations shall include, but be not limited to, regulations pertaining to the following: permitted or prohibited uses; area and dimensional requirements; supplementary matters including, but not limited to, signs, driveways, off street parking and loading, and the sale of alcoholic beverages; environmental and related matters; and special permits and site plans.

    (c)

    The amount of the fine to be imposed and paid to the city treasurer for each violation of a zoning regulation of the type designated above is hereby established and imposed as follows: Ninety dollars ($90.00) for each day that such violation continues.

    (d)

    A citation officer must issue a written warning providing notice of the specific zoning ordinance being violated before issuing a citation. Once the citation is issued, the time period for the uncontested payment of fines for any alleged violation under this section shall be thirty (30) days.

    (e)

    The hearing procedure for any citation issued pursuant to this section shall be in accordance with Section 7-152c of the Connecticut General Statutes and chapter 23 of the Bristol Code of Ordinances except that no zoning enforcement officer, building inspector or employee of the municipal body exercising zoning authority may be appointed to be a hearing officer.
